Gambling Will Continue To Expand In New York. 2005-11-29
On Monday, The U.S. Supreme Court made their decision not to hear a case filed by a group of antigambling organizations. The organizations were planning to overturn a 2001 New York state law that authorized legal gambling in New York, and its expansion. They refused to hear the case, which meant that tribal casinos could open across the state.
The 2001 gambling bill was approved to get revenues up. They were seeking new revenues because the state, in wake of 911 sought to renew economic growth. The law led to the largest amount of expansion in New York's history.
Despite the order, casino gambling is prohibited under the state constitution. Legislature did not have the power to authorize tribal for casino gaming. That argument was rejected in May by the Court of Appeals. They ruled that federal law superseded the state constitution. That means that Indian Gaming and Regulatory Act allows tribes to set up casinos on their own land.
The court had to follow protocol when it came to the decision, and they did. The law has to be upheld over political opinions. No one many personally want tribal casinos, but if that is the law it has to be honored.
